1. Scope of Terms of Contract and Travel
These Terms govern the legal relationship between you in Samui MJM Co., Ltd. on trips organized by MJM Samui Co., Ltd..
For services from third parties, eg. package tours to other organizations or individual services such as airfares, accommodation, car rental, etc. ... you enter into the contract directly with these other providers, and we're not your contractual partner.

2. Conclusion of contract
The contract between you and Samui M.J.M. Co., Ltd. takes effect when you register, communicated in writing, by e-mail or telephone is accepted without reservations.
From that moment, the rights and obligations under the Contract (including these Conditions of Contract and travel) are effective for both you and Samui MJM Co., Ltd..
Special requests are not part of the contract and are subject to acceptance.

3. Price and payment terms
3.1. The holiday price indicated in the description of Samui MJM Co., Ltd.. The cost of living means in Thai Bahts, for housing, meals not included.
A deposit of 50% per case must be paid upon final acceptance of your registration via the booking office.
The remaining 50% is not later than 15 days before your arrival on site
In case of non-payment of the deposit, we have the right to terminate the contract without compensation and to require the cancellation fee according to Clause 4.1.
If you book your trip with less than 28 days before departure, the total amount of the invoice must be paid at time of booking.

4. Cancellation and change
4.1.En cancellation of your stay, the 50% deposit will not be refunded under any circumstances

5. Cancellation by Samui M.J.M. Co., Ltd.
5.1. Cancellations for reasons attributable to the participant
Samui M.J.M. Co., Ltd. is entitled to cancel the booking in case of acts or omissions on your part to justify it. You can then claim any compensation.
5.2 Force Majeure. Strikes
Cases of force majeure (natural disasters, epidemics, social unrest), the steps taken by the authorities or strikes may force Samui MJM Co., Ltd. to cancel the stay. In this case, Samui M.J.M. Co., Ltd. will inform you as soon as possible. If the trip is canceled, the holiday price already paid will be refunded. You will not be entitled to other compensation.

6. Program changes and lack of benefits in travel
If a change of program occurs during travel, significantly affecting your program, MJM Samui Co., Ltd. will in the limit of availability of schedule bookings, changes in rental program desired, no claim will be considered by MJM Samui Co., Ltd.

7. Disclaimer Samui M.J.M. Co., Ltd.
7.1. General
Samui M.J.M. Co., Ltd. will compensate you the value of benefits agreed but not provided or fully furnished, since the service was not able to offer a replacement service.
7.2. Limitations and exclusions of liability
7.2.1. International Conventions
If international agreements provide for limitations on compensation for damages resulting from the failure or imperfect execution of the contract, MJM Samui Co., Ltd. is entitled to rely and its liability will be limited in accordance with the provisions thereof.
7.2.2. Exclusions of liability
Samui M.J.M. Co., Ltd. assumes no liability to you where the failure or imperfect execution of the contract is attributable to the following:
a) negligence on your part before or during travel
b) unpredictable or negligence caused irreparable third from the provision of benefits under the contract
c) an event of force majeure or an event that Samui MJM Co., Ltd or the service provider could not foresee or prevent despite all due diligence. In these cases, Samui M.J.M. Co., Ltd. is exempted from any obligation to pay damages - interest.

8. Insurance
We recommend that you make sure you have an appropriate insurance, in other words to check your private insurance coverage in this regard before making your reservation. Please consult your travel agent about it.

9. Entry requirements, visa and health
You are yourself responsible to inform you of the customs formalities to be valid and in possession of necessary documents (visa, passport, identity card). Please consult your travel agent about it.

10. Governing Law and Jurisdiction
The contract between Samui M.J.M. Co., Ltd. and yourself is subject to Thai law.
For any dispute relating to contracts concluded between Samui MJM Co., Ltd. and participants travel, exclusive jurisdiction is in Thailand.
